This privacy policy applies to CCTV on trains and on RhB premises. Rhaetian Railway Inc, Bahnhofstrasse 25, 7001 Chur, is responsible for CCTV.
The authority responsible for CCTV is specified in the Railway and Passenger Transport Act. The detailed implementing provisions can be found in the Ordinance on CCTV in Public Transport.
Below you will find detailed information on how we use CCTV.
Some trains, stations, level crossings and other RhB premises are monitored by CCTV. Buildings outside RhB premises covered by CCTV are generally excluded from surveillance with bars or pixelation. However, it cannot be ruled out that third parties (e.g. passers-by) may also be captured by the cameras outside RhB premises.
CCTV systems are used to protect passengers, operations and infrastructure.
CCTV should in particular:
Protect staff, travellers, customers and visitors from aggression and harassment
Secure valuables
Prevent damage to property
Make it possible to count passengers for operational safety
Ensure system availability and fast troubleshooting
Support operational monitoring to ensure scheduled rail operations (coordination of train traffic)
Ensure coordination in the event of accidents or natural disasters
The video data is protected against access by unauthorised persons. Within RhB, the operations centre, railway services, operational intervention, railway technicians and safety officers, the Head of Legal Affairs and Compliance and the management have access to infrastructure-side video cameras (stations/buildings, etc.). The train crew on the respective train and the Systems Engineering department have access to the video cameras on the rolling stock side (trains, etc.). They are used for the purpose set out in Section 2.
Outside RhB, the Graubünden cantonal police have access to the infrastructure-side video cameras (stations/buildings etc.) for investigative purposes as do external service providers such as snow clearers, although this is limited to the area under their control.
Log files are used to prevent misuse.
Certain video cameras in which it is not possible to identify the persons captured by the cameras are shown briefly and cyclically on the RhB website in the live stream for advertising purposes.
The video data is only backed up and evaluated by RhB after an incident has occurred. Data may only be released to the law enforcement authorities upon receipt of a corresponding disclosure order/request.
The video data is stored for 30 days at railway stations and 120 hours or 72 hours in vehicles, depending on the generation. Once these periods have expired, the data is overwritten and thus automatically deleted (loop memory).
Data relevant to a specific event is only backed up for further processing after a corresponding event has occurred.
The video data from CCTV on the trains is stored on the trains themselves. Other video data is stored exclusively on RhB’s IT infrastructure in databases within Switzerland.
You can request information about video data concerning you at any time. To exercise your rights, all you need to do is send a letter to our Data Protection Office (see Section 8).
You also have the right to raise your concerns or questions with the Federal Data Protection and Information Commissioner at any time.
